coolbear Posted July 16, 2018 Report Share Posted July 16, 2018 My spouse filed my COS application from H1 to H4 with USCIS in May-2018 and had put requested date as 5/30 and filed EAD application concurrently. My H1 extension , her COS & EAD all were filed together. She received her COS approval on 6/29 ( with effective start date as 5/30, which was past by then ) and H4 EAD with effective start date as 6/29. She was working all along this time even between 5/30 and 6/29 as her COS was not approved till 6/29 ( She did not want to take risk of out of status, had the COS was denied).. My question is, since the COS to H4 approved on 6/29, with effective date as 5/30, does she need to inform USCIS, since she was working ( for the period 5/30 and 6/29)? Link to comment
satya2k1 Posted July 17, 2018 Report Share Posted July 17, 2018 I am not sure what good happens by informing USICS about working during EAD approval process. Technically speaking, your spouse is not suppose to be working until he/she receive the H4-EAD approval. She was not out of status but she had unauthorized work for 1 month. Link to comment
