Ssmailtomess Posted July 3, 2018 Report Share Posted July 3, 2018 I have been with my current employer for 7+ years and have been working as a contractor at different client locations till now. I have accepted a full-time employment offer with a US-based company; they have applied for an H1 transfer and have obtained the receipt notice. If everything goes well and I start working for my new employer, would the future visa extensions go on well based on my previous approved I-140 even if it is revoked? My current employer might revoke the approved I-140 when I resign and my future employer might take some time to file an immigrant petition for me. The situation might be like my approved I-140 is revoked and new I-140 (new employer) not filed yet. Please advise. Link to comment
pontevecchio Posted July 3, 2018 Report Share Posted July 3, 2018 You should be aware that if the I-140 is approved and it is more than 180 days since approval, you are eligible for H1 extensions till that PD is current even if that I-140 were to be revoked. Link to comment
