At the time I wasn't given the option or made aware of the risk of the move. The company filed 3 petitions for location B and they all got denied. I received an email from my employer stating immediate termination based on this as they don't have my role available at location A any longer. The petition notice was given to the company in June 8, 2018. My employer is claiming that they must terminate me immediately based on legality but waited until the 29th to informed me of the such. What are my options? If the option A was still available how long would I have to return to original employment A? Thank you for your help. Link to comment
mehopeful Posted July 2, 2018 Report Share Posted July 2, 2018 Unfortunately, you don't have any options. If your I-94 has expired, you must leave the US immediately. If I-94 has not expired, you have 60 days grace period within which a new employer can file a cap-exempt petition. Link to comment
