What will happen to EB3-140 , can we still use to fill I-485 if EB3 become current before EB2- PD date? Please suggest. Quote Link to comment

kumar1987 Posted April 9, 2019 Report Share Posted April 9, 2019 Hi @gaddesubhash I recently had a I-140 approval in EB2 category but my PD from my old 140 in EB3 did not get retained, was there anything specific during application which was needed to be done to get it retained or does USCIS know it and gives you the old PD in your subsequent I-140? Our attorney is saying request for porting will be done during i-145 application and not during I-140 application, but this seems to be incorrect as you are in the same boat as me and you have your old date in the new I-140.
