Maggy1234
I currently work for company A on H4 EAD. Company A has sponsored my H1B this year and it got picked in the lottery but I haven't received my H1B approval yet. I have got a new offer from Company B. They are willing to apply for a H1B transfer, but since my H1 is not yet active can they even port my H1B to the new company? Do I have to wait till October 1st? Or do I need to wait till I get my H1B approval notice? Or can company B file for I-129 right now and then I switch jobs on my EAD so that starting from Oct 1st, will have my H1B with company B? JoeF
Unless you start working on the H1 for the original employer on Oct. 1, the H1 can't be transferred. Link to comment
