H1B EXTENSION APPROVED- H4 EXTENSION UNDER PROCESS - CAN H4 GIVE BIRTH IN US AFTER 240 DAYS PERIOD?

H1B extension (primary applicant) petition is approved and H4 Extension (I 539) application is under process by USCIS.

1) Can H4 dependant stay legally in US after 240 days (As the H1B extension for Primary applicant is approved and H4 extension is under process).

2) Can H4 dependant be able to legally give birth to baby after 240 days( H4 extension is under process)

Any advice on the above queries is highly appreciated. Thanks in advance!

As long as H4 extension is i process, your spouse is in legal status.So I guess that shouldn't be an issue.

 

How long is your H4 extension is pending ?Which center?
