I am currently on Eb2I with priority date dec 2009. If eb3i priority dates surpass eb2i, then can I file new I-140 in eb3 , in premium processing? Does filing new I-140 in eb3 invalidate my eb2 I-140? If possible can I do it even with out waiting for monthly bulletins? that way I will have 2 I-140s in EB2 and EB3, which ever category priority dates moves ahead first, I will apply for I-485 in that category. please let me know the possibility? thanks kumar Link to comment

JoeF Posted June 9, 2018 Report Share Posted June 9, 2018 The LC determines if it is EB3 or EB2. If you want to change, the employer would have to file a new PERM for a position in the appropriate category. In other words, it would be a completely new application, starting from scratch.
