H1B transfer with Consular Processing

HI All,

My friend employment ended with Employer A, and he got a job with employer B and they have filed the H1-b transfer in consular processing(50 th day after the employment ended with employer A) before the 60 days grace period. now he is past the 60 days grace period and his h1-b transfer is still in processing. the question is  will he be out of status as he is over the 60 days grace period  or is he fine because the h1-b application was applied before the 60 days grace period.
