satya2k1
Hi Friends, When I changed the job, I had about 30 days gap between old job and new job. During great recession, I got laid off but the employer was kind enough to give me some time to change my status. I applied for COS from H1 to F1 based on an I-20 from a local college. During the COS processing, I got a full-time job and employer applied for H1 in premium and got approved in 2 weeks. There was an RFE for COS after my H1 is approved and I replied to the RFE by stating to withdraw my COS application. Now my question, would there be any issue when I file I-485? are there chances of raising an RFE between job changing times? Link to comment
pontevecchio
You do know you had 60 days to report to the new H1 sponsor after H1 petition approval if you were currently in H1 status here. If you always had valid I94'S for the H1 time, there is no issue. Link to comment
satya2k1
I didn't quiet follow your response. But I like that there is no issue :) I have valid I-94s for the whole tenure of my H1 status. Link to comment
pontevecchio
Since you got an I94 with the H1 approval at that time, you are considered to have been in status. Link to comment
