Aamani Posted June 1, 2018 Report Share Posted June 1, 2018 What's the risk of traveling while an I-539 is pending? I was thinking to travel to India. I have applied for F1 Change of Status 8 months ago the Vermont Service center increased their processing time from 9-10 months to 10.5 to 13.5 months. My H4 expires on July 27th. What should I do? JoeF Posted June 1, 2018 Report Share Posted June 1, 2018 An I-539 is a change of status petition. You by definition only have a status while in the US, so if you travel abroad, any pending I-539 is automatically going to be denied. If you want to come back on F1, you would have to get an F1 visa at a US Consulate. Link to comment
