Pankaj Pawar Posted May 31, 2018 Report Share Posted May 31, 2018 Sir, The Immigrant Petition I-130 for my parent was approved in Feb 2018. They arrived to US in same month on Valid Visitor's Visa. I have filed their I-485 in April 2018 for adjustment of Status. They already had their Biometric Finger print on May 2, 2018. Assuming the next step is interview (which sometimes get waived) when should I expect their Green Card. Their I-94 validity is till Aug 15th, 2018. Do I have to file for their I-94 extension so they can keep staying here? Is it required or they can stay after Aug 15 even after expiry of I-94 since Adjustment of status is in progress.? pontevecchio Posted May 31, 2018 Report Share Posted May 31, 2018 The AOS petition keeps them legal to stay. If you get in to any trouble due to filing so soon after they arrived, get yourself a good lawyer pronto as there are precedents by the Immigration courts finding that preconceived intent is not applicable in cases where the applicants would be entitled to leave without any prejudice and get an Immigration visa which would be subject to denial.
