Prina Posted May 26, 2018 Report Share Posted May 26, 2018 Hi, I had an approved h1b in 2015 and it was valid till 2018.however, in 2016 I changed my status to h4. I was on h1b for 8 months. Meanwhile my employer terminated my h1b in the same month that I applied for my change of status to h4. I got my h4 approved till 2019. My question is do I stand any chance of being cap exempt if employer B files for my h1b in future or should I go through the lottery system again? Link to comment

You can claim the remainder 5years and 4 months of H1 status by having an employer filing and getting a H1 petition approved for you non cap with no single period more than 3 years. Link to comment
