Employer is in process of filing H4 extension which may take 2-3 more weeks - probably it will be filed by this month end i.e ., 29-May 2018. I have following questions. Could you please help to clarify a) Based on the USCIS info, USCIS suggests to file i539 at least 45 days before stay expires. In my case 45 days’ time period expires by 24th May 2018. Is it ok to file extension by 29-May 2018? b) Can we file H4 extension independently? If so could you please let me know what could be the process. Thanks Dinesh Link to comment

That is just a suggestion to file before 45 days. As long as your application reaches before I-94 expiry date you should be perfectly fine. 2. Yes. Just file a I-539 with supporting docs.
