Trsh2311@ Posted May 1, 2018 Report Share Posted May 1, 2018 I am currently on H1 and decided to change my status to H4, my spouse's company is filing H4 and H4 EAD for me and I already have my receipt number, based on estimated process times, H4 and EAD is estimated between 1-3months. However, what is not very clear to me is, when do I give my current employer 2 weeks of notice. So how do I decide when to quit my current job? 1. Should I wait till my H4 is approved? Then I cannot work anymore with my employer so I will have to quit immediately, which is not what I want to do (don't want to quit out of the blue, would like to give my 2 weeks notice, in order to not burn any bridges). 2. Can I give my 2 weeks of notice right away and quit working after that? What would my status be in this case, since I would be on H1 until my H4 is approved but I quit and will not be working. Hence give notice any time you want and if the H4 COS is still pending, you are in legal status till the H4 COS is approved. 2. YES. A timely filed COS by you keeps you legal till the decision even if you stop working. Link to comment
