The Extension was filed in Jan-2018 and I have received RFE (after upgrading to premium). I have an approved I-140 since last 1.5 years with the current employer. Question: 1) Can I transfer my visa to a new employer-B before responding to the current RFE as I don't want to take a risk of rejection. 2) If yes, will it cause any issues after transfer if the current is not replied and H1B gets rejected. pontevecchio Posted April 17, 2018 Report Share Posted April 17, 2018 1. No. You can get a H1 petition approved with any employer and return with the visa since your current I94 has expired. Unless this extension is approved, no "transfer" possible. Link to comment
