H4 DropBox Denied due to invalid Visa of parent

Hi,

Spouse, who is on own H1 and travelling  India for first time after getting converted from H4 to H1  and Visa stamping scheduled this week, and son[H4 on my H1] travelled to India. My company went for DropBox for my son including my spouse I797 as evidence[which was not having I94 - which is the main cause of going for H1 stamping].

Got response from Consulate that Parents doesnt have valid Visa. Not sure if its due to my spouse I797 with no I94 caused this.

Now, my query is :

Is it fine that once my spouse gets H1 Visa stamped then my son's dropbox application could be dropped again with stamped Visa of my spouse?
