Shilpa R Posted April 11, 2018 Report Share Posted April 11, 2018 Hello all , my Priority date is 01/11/2017(Eb3) perm is yet to approve & h1b max out on 14th May 2018 , we will be going back to India in last week of April (attorney suggested so ) , can anyone guide me what will be the next process & how long it going to take? Ken7 Posted May 30, 2018 Report Share Posted May 30, 2018 You can apply immediately for a 1-year extension based on a pending 365 day PERM. Alternatively, you can wait for the PERM to be approved, the apply for I-140 in premium processing and once that is approved, apply for a 3-year extension. When you can get back depends on what route you take and if you apply in pp or not. The quickest would be to apply for the 1-year extension in pp. However if the PERM verdict is expected shortly, it would make sense to wait a little then apply for I-140 and then a 3-year extension, both in pp. Link to comment
