RatnaB Posted April 6, 2018 Report Share Posted April 6, 2018 Hi, I have my I-140 approved in 2016 in EB-2 Category and just now completed 6 years on H1B and got the extension for next 3 years based on approved I-140. I am planning to move back to India for 2-3 years due to some family problems. 1. If I will move back to India and change the employer then can I come back to US based on approved I-140 after couple of years and keep the same priority date? 2. I understand that, new employer needs to file H1B petition, so for that do I need to go through the lottery process or it will be CAP exempted (based on approved I-140 with previous employer)? 3. Can any US based another employer/consultant file my H1B petition while I will be in India and after coming back to US they can initiate my GC Process (Perm and I-140) and carry my existing priority date?
