Yogiwaiting
Is client letter mandatory for h1b extension? My client is not willing to issue a letter. I am currently in India after my 1st denial in november. My employer reapplied last month in PP and RFE has been issued with details regarding client letter and SOW's. Please help Link to comment
NotAnAttorney
Ofcourse mandatory per USCIS guidelines. With the current situation, if you are working at a client location and if you are not able to produce a client letter, then it is highly likely that it would not get approved. https://www.uscis.gov/sites/default/files/USCIS/Laws/Memoranda/2018/2018-02-22-PM-602-0157-Contracts-and-Itineraries-Requirements-for-H-1B.pdf Link to comment
Yogiwaiting
@NotAnAttorney thanks! The issue is I am currently in India and my current SOW is for offshore resource. So its getting hard to justify client about the needs. However i have been working for this same client for last 2.5 years now. Link to comment
NotAnAttorney
From the above information, I understand that you are in an MNC and you will still be working for the same client when you come to USA. In that case why is the client not ready to issue a letter, when he is the one for whom you will be doing the specialty job? Link to comment
NotAnAttorney
They can always give letters with details of work like you are currently offshore but will be onsite from XXX date, as required. Link to comment
