bangaloreguy78 Posted March 20, 2018 Report Share Posted March 20, 2018 Hi, I submitted concurrent EB1A I140/I485 3 months back using my own personal lawyer (not employee sponsored). I believe we did a mediocre job. Now I am planning to interview with companies and change jobs. Also, I believe I am eligible for newer EB1A criteria now due to events in past 3 months. Can I either - file a new EB1A I140, and link it to the older I485 application ? I read somewhere that interfiling of new I140 to old I485 can be done. - Or, wait for the old I140 RFE, then in the RFE response add more eligibility evidence ? Please let me know your thoughts, thanks Link to comment

What part of wait for the approval or denial of this petition do not you understand?. If approved move on. If denied, get hold of a better lawyer to file another petition. Link to comment

I do understand the part about waiting for RFE / approval / denial and then refiling fresh I140 if required. The doubt is - what happens of the earlier filed I485 ? Can I use it somehow if the old I140 application is denied / withdrawn ? I read that a new I140 can be linked to an older I485 petition using interfiling. But the process is kludgy I believe. I just don't want to file the I485 again if I apply I140 afresh. Link to comment
