subhadeep2010 Posted March 20, 2018 Report Share Posted March 20, 2018 Hi, I am an Indian citizen and I have been working in US for the last 6 years and I have had my PERM initiated and I-140 approved with my current US employer. However, due to personal reasons, I would like to move and work in Ireland for at least the next 3-5 years. So my questions are : (1) Will my I-140 be valid, if I want to move back to US (that 6months with the I-140 has been satisfied) ? (2) If I have to move back to US after my stint in Ireland or Europe for 3-5 years, will I have to have a new H1B initiated OR, can I continue to have the H1B extended after this 3-5 yrs lag based on the existing I-140 approved petition (just as I am doing it now in US) ? (3) Finally, my fiance (although an Indian citizen now) will be a naturalized Irish citizen in a few years. Will that (i.e. spouse being an Irish citizen) help me in any way to expedite the US PERM process for the I-485 adjudication (i.e waive off the Indian wait time of 8-10 years : my PERM is in EB-2) ?
