Bluewhale Posted March 7, 2018 Report Share Posted March 7, 2018 I’m a H4 dependent and I’m in India now. My husband is in US. My H4 visa is valid till July. His visa validity as per his passport is also July. But his new petition is valid till August. In this case if he needs to apply for H4 extension should I have to be there in US? Does his employer can apply for H4 extension with the passport entry copy (immigration done in India) of me to India? Is there any necessity in case if his new employer require to know about my immigration to India if he processes his extension through the new employer? Link to comment
pontevecchio Posted March 7, 2018 Report Share Posted March 7, 2018 You use the H4 visa as an entry document to enter the country. The POE Officer will want to see the H1 petition approval of your spouse and your stay and I94 will be till the H1 petition expiry. There is nothing called a H4 petition. Hence there is nothing to extend for you. Link to comment

How difficult is it to understand you can come back with a H4 visa and your spouses approved H1 petition? That is the way to get H4 status in the USA. Maybe next time count to ten before responding?
