I was wondering If I can move to Employer-B right after I-140 is approved and still be able to retain the priority date, so that Employer-B can use that in next Labor and I-140 processing. pontevecchio Posted March 16, 2018 Report Share Posted March 16, 2018 Yes, You will retain the PD even if you leave soon after I-140 approval. The new rule is that even if the I-140 is revoked you will get H1 extensions beyond 6 years till the PD is current provided the I-140 has been approved 6 months or more back. This is different from PD retention which has always been possible. Link to comment
