She wants to make a move into ProgramManagement (Scrum master) kind of roles. However we are not sure if there would be any issues with H1B transfer as her role/title will be changed. xTDx Posted May 10, 2018 Report Share Posted May 10, 2018 Natural job progression and promotions within the same role as requested on LCA and h1b application is not an issue and does not warrant h1b amendment. However, in her case ,it looks like she is making some sort of a move into management from a different type of roles. Lets say someone is moving from from Developer/Engineer to a Manager , in such a case a new lca will need to be certified and h1b amendment to be filed for the employee by the employer. Again , you cannot do anything, her employer has to do this. These steps should be taken care by the employers attorneys. If the employer in not taking this initiative for any number of reasons, she should talk to her employer before taking such a position and accepting any payroll changes without a h1b amendment in pipeline.
