NeedHelponVisa Posted February 16, 2018 Report Share Posted February 16, 2018 Hi, I'm currently in my 6th year of VISA and had filed for the H1B visa extension where i got RFE first and upon responding to the RFE with the required documents, i got a denial. I currently have i-140 approved. What are the next options i have here? How long can i stay after i get the denial notice? While looking around, i found some options but not sure how valid those are: 1. Refiling the H1B visa with the same employer 2. Look for a new job and transfer the Visa ASAP thro the different employer 3. Appeal against the Denial notice with the additional documents Can someone please provide some details here and share if anyone has faced the similar situation in the past. Industry Number of employees? How big is company? Is it Foreign based company like Infosys? Most important, did you have valid LCA (unexpired) before this application? Link to comment
