Hello All,

My H1B got approved in November but my employer has been making excuses and has still not shared the original I-797 with me? What options do I have? Please advise.

Cheers !

Tell him u need ur Driving license is getting expired and the dl office needs original i797 to process. Mostly all of the states are tied up with immigration these days and u r license will expire with ur i797.

Most of the employers are really shitholes...

He is not required to. The H1 is the employer's application.

He only has to give you the bottom part, the I-94.

This is 100% true however that's the purpose there are 2 pages of I797 I have seen where you can keep 1 and employer the other. But, in order to protect themselves from you jumping the ships they hold it back

Joef, isn’t original I 797 a requied for visa stamping n at port of entry ?

No, just the bottom part is needed for that. Next to the I-94 at the bottom there is a piece that has all the information needed.

A good employer of course gives a copy of the approval notice to the employee.
