RMS2015 Posted January 10, 2018 Report Share Posted January 10, 2018 I applied for H4 EAD (currently pending) as soon as my husband's I-140 got approved 2 weeks ago. My husband and I have only 4 months of H1B/H4 left on the petition which I used to file the I-765 for the H4 EAD. However just yesterday, we got our H1B/H4 extension approved for the next 3 years. 1. Should I file a new I-765 with the latest receipt# so as to get an H4 EAD that's valid for 3 years? In this case, should I withdraw the currently pending I-765? Or, 2. Will USCIS detect our updated H1B/H4 status on their system and automatically grant the H4 EAD valid for upto 3 years, on the first I-765 itself? Thanks for the advise. Link to comment
