He is currently a manager and went to India for the same company and worked as manager for 12 months (jun to may) but not completed 365 days. He was recruited in US stating the company will file eb1 category since he falls under multinational manager category but had to move out of country for the above mentioned period for few other personal reasons. Is he still eligible for eb2 to eb1 porting? Some forum says he should complete 365 days with same company outside US and some says 12 calendar months. Please suggest. Link to comment
