PJSHAH Posted December 27, 2017 Report Share Posted December 27, 2017 Hi, I have applied for 2018 H1B cap and received my first RFE in July, 2017 for Level 1 wage. My lawyer replied for that RFE with all required documents and detailed job duty description by October 10, 2017. Before few days my status got updated and they have asked for more evidence. This time they have issued Speciality Occupation- Availability of work RFE. They required additional documents from my employer (Tax returns, Statement of work, Client agreement, relevant part of contracts etc.). I am really confused and don't know what to do in order to get it approve? Is anyone having same situation? Any advice will be appreciated. Thank you Link to comment

NotAnAttorney Posted December 28, 2017 Report Share Posted December 28, 2017 If your employer is a consultancy then the there is a very little chance that it gets approved. Are you currently working for the same client, same project same location as mentioned in your petition? Link to comment

My employer replied through its immigration team and what now :( eagerly waiting for the response. In the meantime please update once you get a reply from USCIS. Link to comment
prernasrk Posted July 26, 2018 Report Share Posted July 26, 2018 I had the same RFE and it got approved. All you need to show is client letter which describes that they require a degree to perform these skills and I also provided an expert opinion letter from Silvergate Evaluations. Link to comment
