RavindraD Posted December 20, 2017 Report Share Posted December 20, 2017 Hi, I have query related to H1B cap exempt, as I'm going to complete my H1B 6years by Feb, 2018 and my employer will file PERM(Labor) in Mar,2018. I'll be travelling back to india in Feb, 2018 and I'll wait until my I-140 & H1B gets approved. I wanted to know whether I'll be eligible for H1B exempt from CAP once my I140 gets approved. Could you please let me know whether I'll be exempted from CAP to apply for H1extension or I'll come under H1B CAP once my I-140 gets approved? And if i want to get exempted from CAP after I-140 approval, do I need to leave 2 weeks prior of my 6years expiry date? Link to comment
