Chaitanya26 Posted December 18, 2017 Report Share Posted December 18, 2017 Hi, I am currently on H1-B visa and my I-140 got approved in November and its Received date is Nov 03-2017. Now I want to apply for my spouse H4-EAD. As per many diacussions and issues going on H4-EAD work status, there is some news that any H4 EAD’s filed before Jan 02, 2018 will not have any impact of current rule and USCIS will accept applications. My spouse is currently in India and he will return back in 3rd week of Jan 2018. do I need to hurry up and ask him to come back to US and apply for H4-EAD before Jan 02-2018 or Can i wait? A person by definition is in a status only in the US. Ergo: only a person in H4 status in the US can file an EAD. Link to comment
