Librarian Posted December 14, 2017 Report Share Posted December 14, 2017 Hi, My h1b is set to expire on 12/31/2017. The extension is filed this month by my employer. For some filmsy reason my supervisor is denying premium processing. Now my GC is in progress under eb1 category but my I140 is not approved yet. Under regular processing it may take 6-8 months for approval. Can this gap affect my gc processing in anyway? Can this affect my travel? I still have 2 years to max out on h1. Thanks Link to comment

You are not really depend on H1 at all as you can claim AOS ( adjustment of status) ..You are good even without filing extension. Apply for Advanced Parole (must) and EAD (optional) before leaving the country. In case your H1 Denied to continue to work all you need is EAD. So if you have not applied then go and apply right away. May be thats why your supervisor rejected your request for Premium. Link to comment
