365 day labor ETA 9089

1. 6th year H1B to be exhausted on Feb 2018. 
2. LCA (ETA Form 9089) applied on Feb 2017. 
3. LCA certified and I140 in process from August 2018.
4. Working for Company A, but LCA I140 application through Company B.

 

• I have recommended by a lot of folks to expedite the I140 process, but have a phobia because premium more often than not invites trouble. Want to avoid this.
• I would like to take advantage of  365 day rule ,because of timely application of LCA greater than 365 day. And would be eligible 1 year H1B extension  because my I140 is under process. 
• Do i have to have a file for a H1B transfer to the new company and apply request for H1B extension from that company. How does this work.
