rao.kl Posted December 7, 2017 Report Share Posted December 7, 2017 Hello All, Here is below my case details 1) valid H1-B VISA Stamping until July 2018 2) Passport & I-94 Expired on Sep 16 2017 -> I have applied for Passport renewal and received new passport on May 07 2017 3) H1-B I-797 Expired on June 1 2017 -> Employer A had filed for H1-B Extension by May 30 2017 4) I have received RFE on H1-B Extension on Sep 20 2017 , I have got an opportunity from a better firm and so have filed for an H1-B transfer from Employer B on Oct 10 2017 and last week got RFE with asking to first answer to the RFE on Employer A H1-B petition. As I am still working for Employer A , I have requested them to answer RFE and they have agreed to do it before Dec 20 ( deadline for answering RFE) . But my concern is , > As my H1-B I-797 has ended on June 1 2017 , will the 240 day rule be applicable to my process and would I be deemed to be Out of Status by Feb 1 2018 if in case I do not hear back from the USCIS by that time > As my I-94 Expired on Sep 16 , will the 180 day rule be applicable to my process and would I be deemed to be Out of Status by March 1 2018 if in-case i do not have a valid 1-94 by that time. Can any one please help with this as I have a family to support and planning to prepare to travel back to my home country in case of any adversities. Thank you Link to comment
