Is I 797C filed by the employer for a employment based green card?

Recommended Posts

Hi

My company has filed for my green card in EB2 and currently waiting on the priority date to be current. Currently my I 140 is approved. My daughter (on H4) is finishing high school and applying for colleges. One of the colleges is asking for the I797C to prove that Green card application has been filed.

I wanted to check if the I 797 C is the 1st step in the Green card application and that I can get it from my employer?

Hoping this is an easy answer for one of the experts on the forum :)

Regards

Prasad

pvkprasad,

I797 has nothing to do with green card. It is categorized into several forms with extensions such as A, B, C. C is just acknowledgement that application is received, I797A is approval notice...etc. But they are not related to green card.

I assume you are talking about green card through employment. In its simple form, it has 3 steps.

PERM, I-140, Adjustment of status.

If they are asking for I797, they are looking for proof that you are in US on a valid visa. Better show them I797A or actual visa on her passport. To show that green card is in process, you need to show approved I-140.

I suggest you to educate yourself to avoid future issues.
