EB1 - I485 new form questions

Hello all,

               I need some help with the following items on the new I485 - that I'm not entirely clear on. I would appreciate your advise. I have an EB3 I140 approval and my company filed my EB1 I140 recently without the I485. I was told that since this is EB1, I can go ahead and file the i485 now.

1) when filing i485 for dependant (spouse of H1B) on the new form, In part2, what would be the application category be? Old form had a category that said something like "spouse of temporary worker whose I140 approved" There is no equivalent to this on the new form

2) In the supporting documents should i send I140 receipt of the recent EB1 petition or should I send the I140 approval of the older EB3 petition? Or Both? 

3) In the i485 form, can I use the Alien# assigned on my EB3 application?

4) Two cheques ($1140 & biometric $85) or one cheque of (1140+85 = $1225)?

Did you find a answer for the first point you raised above? I too have a similar situation.

i consulted an attorney and he recommended selecting 1g - Additional Options - Other eligibility and entering "Spouse of I-140 applicant" on the form. I filed the application with the details provided and it was accepted by USCIS. Hope this helps the others.
