desai1981 Posted October 5, 2017 Report Share Posted October 5, 2017 Hi , My PERM has been filed 3 months ago (in the month of June) by my employer ABC and now my PERM is Approved. But 2 months ago (In August) all of the employees have been transferred to XYZ Employer who is a NEW Employer (New employer applied our H1 Transfer) and this is a company to company transition which is a high level (Company) decision. Now I am on H1 Receipt with the NEW Employer (XYZ Company) and my H1 transfer is in progress and also I have got three Paystubs by this Employer. Can My New Employer File I-140 directly or again they need to start G.C Process from the scratch , Though it is company to Company transition , they hired us through H1 Transfer. Note : I am working in the same Location , Client and Project . Out of My total H1 6 years tenure , I am left with only 20 Months. After that I can not apply for extension until my new employer can take it forward. Are there any ways to take my PERM forward from my previous Employer (ABC company) to New Employer (XYZ Company). Please suggest us that what are the best possibilities we have now , to take my PERM forward / Directly apply I-140 and so on. Thanks for your support as always !! Link to comment

desai1981 Posted October 6, 2017 Author Report Share Posted October 6, 2017 Actually , My Previous company has handed over resources and Projects of one of the clients not fully to the new employer. Old emplpyer still exists and working for other clients. They made agreements and based on the agreement they gave resources and projects Link to comment
