Swathi_123 Posted October 5, 2017 Report Share Posted October 5, 2017 Hello Everyone, I was on H4 visa in USA, I had applied for H1B in 2016 and got it approved after 2 rfe's in June 2017. I got my visa approved as marketing specialist, I have completed my MBA in Finance and Marketing and have 2 yrs of exp as i was working in India. Now it is very difficult for me to find a job as I am from non technical IT background and most of the jobs in USA are technical which require H1B's and even if i found a non technical IT job willing to offer me a position due to minimum wage issue with the H1B labor rules I cannot proceed further. Please advise me what I should do at this stage. I want to continue in non technical IT .. Thank you Regards Swathi. Link to comment

It is the employer's responsibility to give you work to do. The employer needs to pay you, even if you are on bench without a project. Link to comment
pontevecchio Posted October 5, 2017 Report Share Posted October 5, 2017 Complain to the DOL on form WH4 with facts only including whether you paid him for filing the H1 petition. They will not take it out on the victim. I suspect the replies to the RFE will make interesting reading. If you are not prepared to uphold the rule of law for whatever reason, leave and return with a H4 visa. Link to comment

Yes at the time of application we had the job and now I am on bench and I my employer asked me to find a new job as he cannot afford me to give me any job for my qualification, I am trying to find a new job with my qualification and experience seems that it is tough so hence asked the above question on the same. Yes thats correct but my employer asked me to find a new job, I am trying to find a new job with the skill sets & exp as I mentioned above but seems that I found few employers but they are not willing to pay the minimum wage which is required i need some suggestions as to what could be done in my case as i dont want to get my h1b approval go for waste. Are you getting paid? On H1, you ALWAYS have to get paid, even on bench. If you don't get paid, file a complaint with DOL on form WH4. Link to comment
