H1-b to l1-b transfer

Hello,

I am currently in USA on my H1b visa which expired in Aug 17. My company has already filed for an H1b extension but received RFE two days back.

I am getting married in Dec 17 and we both wish to continue in USA and looking for options where in he will be eligible to work here.

1. So can I transfer my H1b to l1b as l1b dependent can work?

2. When can I file for status change? Will it be after I get my H1b approval or now that I have received RFE I should go ahead and file for fresh l1b or COS.

3. Someone suggested me to file for l1b on the terms that H1b is getting delayed so need to get l1b as company wants me here.

4. Can you suggest me any other way :-)
