Asha1702
Hello All, I need some help from experts regarding my parent’s eligibility to apply for US citizenship. Per the Guide to naturalization says , one must have 30 months of 'Physical Presence' and one must also show 'continuous residence' , in case one is applying for naturalization, based on permanent resident. Here are the details of their stay in USA. 30-11-12to25-05-12=176 days26-11-13to29-0513=184 days12-01-15to29-06-14=168 days29-11-15to20-03-16=111 days29-11-16 to 25-05-17=177 days When do you think my parents are eligible to apply for citizenship? Greatly appreciate your advice. Link to comment
JoeF
This looks as if they don't really live here. And with being out of the country for more than 6 months quite often, the clock may have reset. Link to comment
pontevecchio
Any stay abroad which is more than 6 months and less than one year leads to a rebuttable presumption that the PR is gone. They would not seem to have stayed more than 6 months in the country at any time since 2015. Moreover have they been filing tax returns ? You need to involve a lawyer to guide you about this matter. If they want to pursue this, they need to come and live here more than 6 months an year for the next 4 years and will also need to make sure they file taxes here unless exempt. Link to comment
