joeh1b Posted April 13, 2011 Report Share Posted April 13, 2011 I am in India and my wife who is a US citizen has filed I 130 for me in Jan after our wedding in Dec. I was in the US till Dec 2010 on H1B with two vendors in between my employer and the end client. I got a 221g when I went for the h1B stamping in India. Now I am trying to get my visa transferred to the primary vendor to work for the same end client. I am pursuing this option since it would take another 6 more months to get my GC, but I could rather get a H1B in a month or two and file I485 after I reach US. The questions I have are: 1. Would it be advisable to do a H1B transfer to the primary vendor through whom I was previously working at this end client, especially when I have a 221g pending at the consulate. 2. Can I be in the US at any point of time legally on H1B with a I130 pending approval. 3. Can I travel to the US when I have a I130 approved. 4. How soon should I file I485 after I reach the US. Based on my situation mentioned above, do you think there is any risk (at the consulate for stamping/POE etc) in going ahead with my plan. Thanks in advance! Link to comment
