mg50
Hello, I am in US on H4 visa which is valid till Feb 2019. My employer has applied an H1 B petition for me and it was approved last week as COS. It becomes effective from 1st Oct 2017. However I need to travel to India in mid Oct ( can travel earlier if required) for a couple of months and I will be back by end of December 2017. I wanted to know what is the best way to go forward. Should I get my H1 stamped in India or is it possible to come back to US on my H4 visa and apply for a COS again to H1B. Will this travel impact the validity of my newly approved H1 B petition in any way? Thanks for the suggestion. Link to comment
JoeF
It is best to get an H1 visa stamp. For a COS to H1, the employer would have to file and pay for the whole process again. Link to comment
