Her current i94 has expiration as Oct 2018 while my i797 h1b approval notice has expiry as Nov 2019. What will be the expiration date on her EAD? What does USCIS use to decide on the expiration? Note: The reason i94 didn't have h1b expiry date is because CBP used the visa expiration date instead when we re-entered US a few months ago. Can someone help with the question above? Link to comment
pontevecchio Posted August 2, 2017 Report Share Posted August 2, 2017 Since an error was made, you could request the Airport CBP to correct her I94 as visa expiry is IRRELELVANT for the I94 which is based on your H1 petition expiry unless she showed an older H1 petition to CBP. Link to comment

Get the I-94 corrected and then apply for H-4 EAD. You can do it at any CBP location at airport. Link to comment
