helpwithquestions Posted August 1, 2017 Report Share Posted August 1, 2017 Hi, Planning to travel to india on a vacation for 2-3 weeks using valid EAD AP combo card. It expires on Jan 2019. My I-485 is pending for more than approx 5 years now and my current employer is not the one who filed my PERM and I-140...Incase my current employer does start laying off employees and if it effects me while i am on my vacation, can i still use my Advance parole based on my pending I-485(AOS) to re-enter US ? Do we need to be employed while re-entering US on AP ? Link to comment

The only role of the POE officer at secondary inspection, assuming this is your first time using AP is to confirm from the computer that you are pending AOS and have a valid AP so that you can be paroled in. Another quick question - as per my scenario, is there a chance that current employer layoff effects my pending AOS or AP ? Link to comment
pontevecchio Posted August 2, 2017 Report Share Posted August 2, 2017 There may be a random RFE asking for proof of an EVL and by that time you should be set in a similar job to use AC21. Returning is not an issue. Link to comment
