kaylogics
My employer just realized that they made a mistake in the offer letter which was attached to the H1B petition. The petition is filed for the category "Computer Systems Analysts" whereas the job offer letter says "Web Developer". The person compiling the docs interchanged the category on the job offer letter with another H1 petition. Will the petition be straightaway rejected or they 'll issue an RFE? Link to comment
rksingh
Most probably an RFE since error is in supporting documents rather than on I129 form or wrong payment etc. You can ask your employer to withdraw current petition and refile with correct documents. Link to comment
kaylogics
In case of refiling will it again be subject to lottery next year? Link to comment
JoeF
A refile would have to be in next year's quota. Link to comment
