NJ2020 Posted April 17, 2017 Report Share Posted April 17, 2017 If a person on H1B visa enters US in 2014 and receives I 94 valid until Oct 2015 and H1B visa valid until 2017. In early 2016 he changes roles within the same company, the company filed I 129, which got approved and he received a new I 94 in early 2017 that is valid until 2019. Which I94 is to be held true, the one that is online(2015)or the paper one that he received now which came at the bottom of I797A(2019)? Link to comment
rohang Posted April 18, 2017 Report Share Posted April 18, 2017 latest I94 with 797A is valid. on parallel note, you mentioned you got original I94 valid thill OCT 2015, was I129 filed before that? if not, thr is a chance you accumulated some out of status. Once you enter US, I94 takes precedence over visa. I would suggest, you to discuss this with your lawyer. Link to comment
