redrose55 Posted April 15, 2017 Report Share Posted April 15, 2017 My wife is on H4 visa rightnow. I applied for her H1B visa in 2016 and still there is no approval from USCIS. She got RFE and documents were submitted in Novermber,2016. So current status of her H1B is RFE documents received. So the current situation is like - She is pregnate rightnow and she is not in the situation of finding a job for next upto 1 year or more. So we are looking for a possible solution for her change of status: 1) Current status - H4 : What if we withdraw her H1B application even before approval. 2) Status change from H4 to H1 to H4 : Wait for her H1 approval, then withdraw H1 and come back to H4 visa. - WIll there be any issue of chaging status from H1 to H4? She is not going to work on H1 and as soon as we got H1B approval, I will request for H1B withdraw. - I heard like if H1B application approved and if someone withdraw it then in future(within 6 years of approval) that person can again apply for H1B without passing through quota or lottery process. rohang Posted April 15, 2017 Report Share Posted April 15, 2017 it seems you paid for h1b, which is illegal. if not, then why do you care? let employer take care of this. once h1b is approved, she can go out of US and come back on H4, this will allow her to keep h4. Link to comment
