Criminal Alien : Will a person considered to be a criminal alien even if the charges against him were dismissed.

With the recent deportations, just wanted to know the extent to which people on H-1 with criminal issues are affected. Will a dismissed misdemeanor charge make you deportable even if it was taken in account before stamping ?

There were no deportations of people on H1 (yet.) There were denial of entry for people from certain countries. That travel ban is at this time not in force, due to court decisions.

There is an Executive Order about investigating if people can get deported with certain criminal issues. That may require a law change.
