Simultaneous EB-5 and EB-2

Recommended Posts

Hi - I am in the US on H1-B visa. My employer filed a PERM application (EB-2 category) on my behalf in Sep 2016 which was approved in Dec 2016. Since I knew that the EB-2 route may take 7-10 years to get a green card (I am from India), I also filed my i-526 (EB-5 Regional Center Program) in July 2016 and waiting for the petition to be approved (expected to approved late 2017).

Since the PERM application is approved, my employer is going to file i-140 very soon. My question is – does the approval of i-140, which is expect to be approved by Mar 2017, will have any impact on my pending i-526 application? Someone told me that I cannot have two approved Green Card applications which implies that if i-140 (EB-2) is approved, the i-526 (EB-5) application cannot be approved

I140 is employer petition..it does not mean that "your GC" application is pending...if it matters at all then only when you file your I485..which is unlikely in the near future..
