Sekhar25 Posted October 5, 2016 Report Share Posted October 5, 2016 I am currently on J1 VISA and my J1 is set to end on December 31, 2016. I am waiting for J1 waiver approval from DOS and USCIS. I would highly appreciate your insight/comments on following questions. 1) Is it possible to file for change of status (J1 to H1B) with waiver approval letter from DOS, incase if the applicant do NOT receive the final waiver approval letter from USCIS before the expiration of his J1 VISA? 2) Can the applicant file for COS (J1 to H1B) during the grace period (after expiration of J1 VISA)? JoeF Posted October 5, 2016 Report Share Posted October 5, 2016 Filing for an H1 would only be possible is the H1 job is cap-exempt. As for the waiver issue, why don't you ask the employer's lawyer? Link to comment
